FlyWire Terms of Service & Privacy Notice

Scientific publications derived in part from use of FlyWire should cite our preprint, Dorkenwald et al. 2020 and the website, flywire.ai. FlyWire is based on EM image data that was released by Zheng, Lauritzen et al. 2018 under a CC-BY-NC 4.0 International license, so this paper should also be cited in scientific publications. Data generated by FlyWire will be made publicly available to the scientific community, in accordance with FlyWire Principles.

1. Terms of Service

FlyWire is a site dedicated to neuroscience research. By accessing the FlyWire website (the “Site,” defined as all pages at http://flywire.ai/ and its subdomains), you agree to be bound by the FlyWire Principles and by the following terms:

  1. If you are less than 18 years of age, your parent or guardian must read, explain, and agree to the terms.
  2. Each edit or annotation of a cell may be made public, including your username, date and time of the edit or annotation, and possibly information about that cell, consistent with the concept of authorship. Your edits and annotations are not considered personal data. You agree that they will be made freely available under a CC-BY-NC 4.0 license, following procedures defined by the community.
  3. You agree to contribute information about cells that you work on in FlyWire, including degree of proofreading completion and cell name if known.
  4. FlyWire may place small files on your computer's hard drive known as “cookies,” in order to personalize your visits to the Site. Most web browsers automatically accept cookies, but you may prefer to modify your browser settings to decline them. If you decline cookies from FlyWire then functionality may be impaired.
  5. The project may terminate, suspend, or block your account at any time. This may be done, for example, if you engage in abusive behavior; create a false identity; disseminate or transmit spam, advertisements, or solicitations; post material that infringes a copyright, trademark or patent right, trade secret or other legal right of any person, corporation or institution; collect, print out, reproduce, distribute, or otherwise make available or use outside of FlyWire any personally-identifiable information about other users; disseminate or transmit viruses, Trojan horses, worms, defects, date bombs, time bombs, malware, spyware, or other items of a destructive nature or any other malicious code or program; use the Site in any manner that could damage or overburden other sites; use the Site in any manner that would interfere with any other party’s use of the Site.
  6. FlyWire reserves the right to change this Agreement at any time. By accessing FlyWire after modifications have been posted, you agree to be bound by the modified terms.

DISCLAIMER OF WARRANTY/ LIMITATION OF LIABILITY
FlyWire is a project of researchers and staff in the Princeton Neuroscience Institute of Princeton University. You agree that your use of the Site shall be at your own sole risk. To the fullest extent permitted by the law, Princeton University disclaims all warranties, express or implied, in connection with the Site and your use thereof. Princeton University makes no warranties or representations about the accuracy or completeness of the Site’s content (including User-Generated Content and Third-Party Content) or the content of any websites linked to this Site and assumes no liability or responsibility for any (1) errors, mistakes, or inaccuracies in content; (2) personal injury or property damage, of any nature whatsoever, resulting from your access to and use of the Site; (3) any unauthorized access to or use of Princeton University’s secure servers and/or any and all personal information and/or financial information stored therein; (4) any interruption or cessation of transmission to or from the Site; (5) any bugs, viruses, Trojan horses, or the like that may be transmitted to or through the Site by any third party; and/ or (6) any errors or omissions in any content or any loss or damage of any kind incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available via the Site. You assume all risk as to the quality, function, and performance of the Site, and to all transactions you undertake on the Site, including without limitation submission of any User-Generated Content.

You agree that Princeton University will not be liable to you for any loss or damages, either actual or consequential, arising out of or relating to these terms, or your (or any third party’s) use or inability to use the Site, or your placement of User-Generated Content on the Site, or your reliance upon information obtained from or through the Site, or your communications with other users of the Site. In particular, Princeton University will have no liability for any consequential, indirect, punitive, special or incidental damages, whether foreseeable or unforeseeable, (including, but not limited to, claims for defamation, errors, loss of data, or interruption in availability of data), arising out of or relating to these terms, your use or inability to use a site, your placement of content on the Site, your reliance upon information obtained from or through the Site, or your communications with other users of the Site, whether based in contract, tort, statutory or other law, except only in the case of death or personal injury where and only to the extent that applicable law requires such liability.

INDEMNIFICATION
You hereby indemnify, defend and hold harmless Princeton University and all its affiliates, employees, faculty members, fellows, students, members of their governing boards and agents (collectively, the “Indemnified Parties”) from and against any and all liability and costs, including, without limitation, reasonable attorneys’ fees, incurred by the Indemnified Parties in connection with any claim arising out of any breach by you or any user of your account of this user agreement or the foregoing representations, warranties and covenants. You shall cooperate as fully as reasonably required in the defense of any such claim. Princeton University reserves the right, at its own expense, to assume the exclusive defense and control of any matter subject to indemnification by you.

2. Privacy Notice

FlyWire.ai (“FlyWire” or the “Site”) respects and protects the privacy of your personal data. This notice contains information about how and why FlyWire collects your personal data and what we do with that information.

  1. What constitutes “Community Data”?

    If you are a professional scientist, we request your real name, email address, institution, city, lab head name, and research interests, and will consider this information “Community Data”, to be shared among FlyWire users for purposes including communication and collaboration. If you are not a scientist, you may choose to volunteer your real name for credit attribution, in which case the information will be treated as community data. Cell edits within FlyWire are not considered Community Data, and are openly visible to all users. Cells marked for public release outside FlyWire will be associated with the names of users who contributed to those reconstructions, for credit attribution, which will not be considered Personal Data.

  2. What Constitutes “Personal Data”?

    FlyWire may collect personal data about you, including your name, email address, IP Address, URL requests (including time, method, and status code), URL that referred you to the Site, number of bytes transferred, web browser, operating system, and hardware platform. Cell edits within FlyWire are not considered Personal Data, and are openly visible to all users.

  3. How We Collect Community and Personal Data

    The personal data that FlyWire holds about you is obtained from a number of sources including information you supply at the time of registration, site usage statistics, and the FlyWire Forum. FlyWire reserves the right to record communications on the FlyWire Forum. These may be made public, omitting your personal information.

  4. Why We Process Community and Personal Data

    Our primary reasons for collecting and using Community and Personal Data include, but are not limited to, facilitating collaboration between you and other users, helping users conduct scientific research, assessing site usage, improving the Site, mediating between users, and granting credit for work done. When you use FlyWire, you agree that we can process Community Data and your Personal Data for administrative and collaborative purposes.

  5. Sending Personal Data to Other Countries

    In certain circumstances, personal data may be transferred to countries outside of the United States, including countries which may not have data protection laws that offer the same protections as your home country. Examples of circumstances when personal data may be transferred outside the U.S. include:

    • Mediating between users.

    The European Commission has produced a list of countries which, according to the Commission, have adequate data protection rules. The list can be found here: http://ec.europa.eu/justice/data-protection/international- transfers/adequacy/index_en.htm.

    If the country that we are sending your information to is not on the list, or is not a country within the EEA (which means the EU, Liechtenstein, Norway and Iceland), then it might not have the same level of protection for personal data as the EU provides.

    Upon request, we will provide you with additional information about the safeguards which FlyWire has in place outside of this privacy notice. If you have any questions about the safeguards that are in place, please contact flywire@princeton.edu.

  6. How We Share Your Community and Personal Data

    Your name, email address, institution, city, lab head, research interests, and FlyWire edits will be visible to other FlyWire users. Your name (but not your email address) may also appear in publications, presentations, promotional materials, and other locations outside the Site. Community and Personal Data associated with your login email or your IP address will not be disclosed to parties outside of the FlyWire community except in very limited circumstances, including sharing:

    • With our service providers: We may share your Community and Personal Data with third parties that help us provide services to you.
    • To improve our services: For example, we may occasionally use consultants, experts, or other advisors to assist FlyWire in fulfilling its obligations, help run the site properly, and monitor or improve the security of our network.
    • With government entities: In response to a valid government request, we may share your Community and Personal Data with a government agency or law enforcement. We may also be required to report certain personal data to comply with our obligations under U.S. law or to protect our rights or the rights of others, or prevent fraud or other criminal activity.

    You agree to be contacted by FlyWire and its users through email, Chat, and the FlyWire Forum (http://flywire-forum.slack.com).

  7. Special Categories of Personal Data

    FlyWire will not collect personal data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, genetic information, health information, or information about sex life or orientation.

  8. How Long We Retain Your Community and Personal Data

    We keep your Community and Personal Data for as long as we need to in order to grant you credit for your work, and allow your contributions to the shared dataset to be used for research purposes by others.

    We may keep certain personal data indefinitely for research or statistical purposes.

    We will also keep your personal data for as long as necessary to comply with applicable record retention laws and obligations.

  9. Our Legal Basis for Processing Your Community and Personal Data Under GDPR

    This notice complies with the European Union’s (“EU’s”) General Data Protection Regulation (“GDPR”). This regulation may apply to the processing of personal information that you provide FlyWire while you are in the EU, but it does not apply to information that you provide while you are in the U.S..

    This section contains information about the legal bases that we are relying on, for purposes of the GDPR, when processing your Community and Personal Data.

    Legitimate interests

    Absent overriding, countervailing interests, FlyWire may process your Community and Personal Data for its legitimate interests. Specifically, FlyWire has a legitimate interest in:

    • Providing a platform where scientists and members of the public can reconstruct neural circuits in a shared dataset;
    • Promoting the objectives and interests of FlyWire, including dissemination of scientific results and recruitment of new users;
    • Facilitating the efficient operation of the Site; and
    • Ensuring that all relevant legal obligations of Princeton University are complied with.

    Legal obligation

    FlyWire may process your Community and Personal Data in order to comply with a legal obligation. For example, we may have to disclose your information to third parties such as the courts, local authorities, or law enforcement where legally obliged to do so.

    Vital interests

    FlyWire may need to process your Community and Personal Data to protect your vital interests, or someone else’s, for example to prevent someone from being seriously harmed or injured.

    Public interest

    FlyWire is acting in the public interest when providing a collaborative platform for scientists and members of the public, and we may process your Community and Personal Data in connection with that public interest.

  10. Your Rights Under GDPR with Regards to Your Community and Personal Data

    Under GDPR, subject to certain limitations and conditions, you have the following rights with regards to the processing of your data:

    • Right of access: You have the right to request a copy of the Community and Personal Data that we hold about you.
    • Right of rectification: You have the right to correct Community and Personal Data that we hold about you that is inaccurate or incomplete.
    • Right to erasure: In certain circumstances, you have the right to request that certain Community and Personal Data we hold about you be erased from our records, but not cell edits.
    • Right to restriction of processing: In certain circumstances, you have the right to restrict certain processing of your personal data.
    • Right of portability: You have the right to request that personal data we hold about you be transferred to another organization.
    • Right to object: You have the right to object to certain types of processing of your personal data, such as direct marketing (to the extent applicable).
    • Right to judicial review: In the event that we refuse a request under rights of access, we will provide you with a reason. Individuals in the EU have the right to object as outlined in the “Further Information and Guidance” section below.

  11. Further Information and Guidance

    Please contact flywire@princeton.edu if:

    • You have any questions or concerns.
    • You object to us using your personal data for marketing or collaborative purposes, e.g., to send you information about the site.
    • You would like us to update the personal data we hold about you.
    • You would prefer that certain information is kept confidential.

    If you believe that we have not acted properly when using your personal data you can file a complaint with the appropriate supervisory authority in the EU.

EFFECTIVE DATE OF AGREEMENT
The effective date of this policy is September 16, 2021.
